Richie\'s suit named Apple itunes, Wal-Mart, Real Rhapsody and Johnny Ramone\'s estate for the digital use of the six songs Richie wrote while being in the Ramones, including Somebody Put Something in My Drink.

Richie claimed he had digital rights when he signed his contract with the band. But according to US District Judge Shira Scheindlin the contract clearly covered digital uses of Richie\'s songs.

She noted that the contract defining phonograph records contained the words \"now or hereafter known\" when referring to forms of reproduction, making it clear that future technologies are covered by the agreement.
