Felice Catena, the sister of the late Knack drummer Bruce Gary, has filed a lawsuit against Capitol Records in LA County Superior Court.
She claims Capitol is paying only a fraction of what she's owed on download proceeds for Knack hits like My Sharona and Good Girls Don't.
Bruce Gary, long-time drummer with The Knack, died on August 22, 2006 after a long struggle with non-Hodgkin lymphoma. His sister inherited the rights to his music.
According to the complaint, the record label owes Felice Catena 50% of receipts from sales of his music by iTunes, eMusic, Amazon, and other download sites.
Back in the day recording contracts didn't contain provisions for digital downloads so it isn't clear whether labels should pay the artist their sale fee (around 12%-18%) or their licensing fee (around 50%).
Felice claims sales through digital distributors are actually licenses - and should be paid accordingly.
She may have a case: Eminem sued his record label for the same thing four years ago and won.
